Summary: The Government of Rajasthan has granted conditional exemption from Section 22 of the Rajasthan Shops and Commercial Establishments Act, 1958. This exemption applies to registered shops and commercial establishments and allows them to employ female workers during night shifts, subject to the following conditions:
Female employees must provide written consent before being assigned night duty.
Employers must issue appointment letters and photo identity cards to female staff.
Employers are responsible for ensuring complete safety of female employees during night shifts, including providing safe transport between home and workplace.
Separate restrooms and locker facilities must be available for female staff at the workplace.
Pregnant women cannot be assigned night duties during the three months before and after childbirth.
Employers must have effective measures in place to prevent sexual harassment at the workplace.
If any of the above conditions are violated, the exemption will automatically be cancelled, and the employer will be held legally accountable under the relevant laws.
