Delhi Transgender Persons (Protection of Rights) Rules, 2025 – Summary
Purpose & Legal Foundation
Framed under Section 22(1) of the Transgender Persons (Protection of Rights) Act, 2019.
Came into effect via Gazette notification dated 11 July 2025.
Identity Certificate Process
Transgender persons may apply for a Certificate of Identity through the District Magistrate or the National Portal.
Requires submission of Form-1 and an affidavit (Form-2) affirming self-identified gender.
No medical examination needed under Section 6.
Those opting for medical gender affirmation can apply under Section 7 with a certificate from a medical authority.
Certificates are issued within 30 days (Section 6) or 15 days (Section 7).
Identity Cards: Form-5 (Transgender); Form-6 (Post-gender-change).
Government documents must be updated within 15 days of application.
Appeal & Grievance Mechanism
Rejections must be communicated within 30 days.
Applicants may appeal within 90 days to the Divisional Commissioner.
Grievance redressal helpline and outreach centres to be established within 1 year.
Welfare & Non-Discrimination Measures
Formation of Transgender Welfare Board chaired by the Social Welfare Minister.
Review and adaptation of schemes in education, employment, health, housing, and social security.
Designation of one government hospital to offer free gender affirmation surgery and related services.
Sensitization mandates for schools, colleges, health services, workplaces.
Anti-discrimination committees required in all educational institutions.
Equal Employment Opportunities
Mandatory Equal Opportunity Policy in all establishments.
Safe, inclusive workplaces with facilities like unisex toilets and protection measures.
Confidentiality of gender identity.
Appointment of complaint officers; policy must be displayed publicly or online.
